La llicència d’obertura i activitat és un document que acredita el compliment de les normes d’habitabilitat i ús de l’activitat, és una llicència municipal obligatòria per a exercir una activitat comercial, industrial o de serveis.
Si es canvia d’activitat o es traspassi el negoci, s’haurà de renovar.
De cara a adquirir o arrendar un local, ha de tenir present l’adequació als requisits exigits per a l’activitat a desenvolupar. Fins i tot en aquells casos en què ja hi hagi una llicència antiga haurà d’analitzar si compleixen la normativa actual.

1. Tipus d’Obertura
Hi ha dos tipus de llicència en base al grau de molèstia, danys o riscos
- Activitats innòcues: no generen molèsties, ni impacte mediambiental, danys a béns públics o privats. Generalment es consideren activitats innòcues la majoria de comerços petits d’alimentació de productes no peribles, botigues de tèxtil, oficina de prestació de serveis.
- Activitats qualificades, activitats insalubres, molestes, nocives o perilloses (determinats comerços, hostaleria), s’han d’adaptar a les mesures correctives sanitàries, de seguretat i mediambientals. Generalment en sòl industrial.
- Resten exemptes aquelles activitats artesanals, professionals i artístiques que es duen a terme al domicili, sempre i quan no hi hagi venda directa, atenció al públic o causi molèstia als veïns.
2. Informes i projectes tècnics
En les activitats innòcues cal adjuntar un informe tècnic que inclogui els plànols del local realitzats per un professional (arquitectes, arquitectes tècnics, aparelladors i enginyers tècnics industrials que cas estiguin col·legiats).
En les activitats qualificades serà necessari acreditar un projecte tècnic més complet que variarà segons les característiques i dimensió del negoci.
L’informe ha de contemplar les característiques del local i de l’activitat: plans, dimensions, reformes realitzades, instal·lacions i compliment de les normes aplicables.
Cal tenir en compte els requeriments de la Llei d’accessibilitat per a persones discapacitades i la llicència d’obra en el cas d’executar una reforma.
S’estableixen altres normes aplicables per a determinades activitats, com poden ser les d’higiene i manipulació d’aliments, insonorització, normativa en cas d’incendis.
Pel que fa a les activitats en domicilis, no se solen concedir llicències per sobre del primer pis d’un edifici residencial.
3. Cost de llicència i obertura del negoci
El cost de la llicència d’obertura té dos components:
- taxes de l’ajuntament
- cost de l’informe o projecte tècnic
En relació a les taxes de l’ayto, es tenen en compte tres factors:
- rellevància comercial del carrer
- la mida
- el tipus d’activitat
El seu import que varia depenent la ubicació i el tipus d’activitat.
El cost de l’informe o projecte tècnic depèn de la complexitat del projecte, pot oscil·lar des dels 600 a 1.000 euros arribant a aconseguir fins als 10.000 si es necessiten permisos especials.
4. Sol·licitud de llicència d’obertura i activitat
El Reial Decret Llei 19/2012 de 25 de maig de mesures urgents de liberalització del comerç i de determinats serveis va introduir importants novetats per racionalitzar i flexibilitzar la concessió de les llicències d’obertura per part dels ajuntaments, el que va ser cridat al seu moment com llicències express.
En aquells locals de menys de 300m2 n’hi ha prou amb una declaració responsable o comunicació prèvia a l’aj en què l’autònom es compromet a comptar amb la llicència d’obertura corresponent.
Segueix sent necessari presentar un informe tècnic i abonar les taxes municipals, que s’acompanyarà amb una declaració responsable. Amb la presentació d’aquests documents es pot arrencar, però igualment caldrà obtenir la llicència d’obertura definitiva un cop l’Ajuntament hagi realitzat les inspeccions pertinents.
En base a tot l’anterior, el procediment consta de 5 passos:
- Elaboració de l’informe tècnic o projecte tècnic de llicència d’obertura
- Visat del projecte pel corresponent Col·legi Oficial
- Pagament de les taxes municipals
- Presentació de la declaració responsable i la sol·licitud de llicència d’obertura, caldrà presentar el projecte tècnic i el resguard del pagament de les taxes municipals.
- Visita de tècnic competent de l’Ajuntament.
La resolució pot oscil·lar entre un-dos mesos fins a un any.
