Canvi de criteri en el Registre Diari d’Hores de la Jornada Completa
Benvolguts clients,
Ja vam informar en la nostra anterior noticia de la publicació de dos sentències de l’Audiència Nacional que havien donat peu a que per la Inspecció de Treball s’exigís el registre diari d’hores, no només dels treballadors a jornada parcial, sinó també d’aquells altres que estan a jornada completa. Amb això, la Inspecció pretenia evitar el frau en la realització d’hores extraordinàries i procurar la seva correcta vigilància, retribució i cotització. D’aquesta manera va arribar a dictar la Instrucció 3/2016.
I no pocs maldecaps ha comportat des d’aquest moment per a moltes empreses dur a la pràctica aquesta exigència.
Recordem que la problemàtica part del Reial Decret Llei 16/2013, de 20 de desembre, de mesures per afavorir la contractació estable i millorar l’ocupabilitat dels treballadors inclou en la Llei de l’Estatut dels Treballadors una disposició que contempla el registre diari de la jornada dels treballadors i l’obligació de l’empresari de portar el còmput de les hores dels seus treballadors a temps parcial.
En principi la redacció és clara i només s’exigeix el registre per als treballadors a temps parcial, però aquesta nova obligació venia d’un canvi d’interpretació de l’article 35.5 de l’Estatut dels Treballadors referit al control del “còmput d’hores extraordinàries” en el sentit que, tot i que el precepte es refereixi al còmput de les hores extraordinàries, l’obligació prevista en aquest article només pot complir-se portant un registre de la jornada diària de cada treballador; perquè només a partir de la determinació de quina és la jornada efectivament realitzada es pot discriminar quines hores tenen la consideració d’ordinàries i quins d’extraordinàries; de manera que tant el treballador com és el cas l’autoritat laboral, pugui conèixer si s’està o no realitzant hores extraordinàries i pugui constatar també si supera o no el límit de les previstes legalment l’any. Aquesta era la nova interpretació que va fer l’Audiència Nacional i que ha emparat l’inici de campanyes i actuacions per part de la Inspecció de Treball.
Doncs bé avui s’ha fet pública la Sentència dictada pel Ple de la Sala del Social del Tribunal Suprem de data 2017.03.23 que, calculant un recurs de Bankia contra la sentència de l’Audiència Nacional de data 2015.12.04 que condemnava a l’esmentat banc, atenent una demanda dels sindicats, a establir un sistema de registre de la jornada diària efectiva que realitza la totalitat de la plantilla.
El Suprem casa i anul·la aquesta sentència determinant ara que la llei actualment no conté aquesta obligació per a tots els treballadors, sinó només una obligació de controlar quan hi hores extres. Textualment: “l’article 35-5 de l’ET no exigeix l’administració d’un registre de la jornada diària efectiva de tota la plantilla per poder comprovar el compliment dels horaris pactats”.
I en matèria d’infraccions afegeix: “La manca de portar, o incorrecta portar el registre, no es tipifica per la norma com a infracció de forma evident i terminant, el que obliga a una interpretació restrictiva i no extensiva d’una norma sancionadora com la continguda en l’article 7-5 del RDL 5/2000, de 4 d’agost, sobre infraccions i sancions en l’ordre social, norma la naturalesa sancionadora impedeix una interpretació extensiva de l’art. 35-5 de l’IT, ja que és principi de dret el de la interpretació restrictiva de les normes limitadores de drets i de les sancionadores “.
Això sí el Suprem admet que “convindria una reforma legislativa que aclarira la obligació de portar un registre horari i facilités al treballador la prova de la realització d’hores extraordinàries”, però “aquesta obligació no existeix per ara i els tribunals no poden suplir el legislador imposant a l’empresa l’establiment d’un complicat sistema de control horari, ”
